    BASSETERRE St. Kitts, April 8th 2011 - The Eastern Caribbean Copyright Licensing Association, (ECCLA), has been incorporated in the OECS Member States. ECCLA was established to ensure that creators and publishers of image and text-based works are protected and remunerated for the copying of their copyrighted works. The first meeting of ECCLA was held in Barbados on Tuesday March 29th 2011. The meeting adopted the proposed byelaws of the Association and developed a three-year business plan, which includes a membership drive. The meeting also agreed to the execution of both a management and a bilateral agreement with the Jamaica Copyright Licensing Agency, (JAMCOPY) to assist in the effective administration of the work of the new Association.
     

     

    The establishment of ECCLA grew out of a series of consultations sponsored by the World Intellectual Property Organisation (WIPO) and the International Federation of Reproduction Rights Organisations (IFRRO), on the establishment of a single Reproduction Rights Organization (RRO) that would service the small Member States of the OECS, and give rise to economies of scale.

     

     
    The goals of the Association are consistent with collective management of reprography, and ECCLA will, as a representative of creators and publishers from the OECS Member States, seek to create a compliance culture and encourage and protect the creativity of its members. Writers, photographers, poets, composers, illustrators, artists and other visual creators whose work is published in printed form and publishers of books, magazines, newspapers and other periodicals are invited to join ECCLA.

     

     
    ECCLA's day to day management will be effected at its principal office in Saint Lucia, by a Board of Directors comprising Dr Simon Jones-Hendrickson of Saint Kitts and Nevis as President, McCarthy Marie of Dominica as Vice President and Michael Fontenelle of Saint Lucia as Treasurer.

     

     
    Other directors include Wayne A M Williams of Grenada and Desiree Richards of Saint Vincent and the Grenadines. Lydia Elliott of Saint Lucia was appointed at the first meeting of the Association to serve as Secretary.
     

     

    ECCLA is one of 5 organizations established in the Caribbean to protect the interests copyright holders of image and text-based works; the others being JAMCOPY in Jamaica, the Trinidad and Tobago Reprographic Rights Organisation (TTRRO), the Barbados Copyright Agency Inc. (BCOPY) and the Belize Copyright Licensing Agency (BECLA).

    Background

     

     
    The Eastern Caribbean Copyright Licensing Association, Inc (ECCLA) is a copyright collective serving the creators, publishers and users of copyright protected works in the Member States of the OECS. The establishment of ECCLA grew out of a series of consultations sponsored by the World Intellectual Property Organisation (WIPO) and International Federation of Reproduction Rights Organisations (IFRRO), on the establishment of a single Reproduction Rights Organization (RRO) that would service the Caribbean region. In order to move towards the establishment of the Regional RRO, individual country RROs must be established and for the Member States of the Organisation of Eastern Caribbean States (OECS), ECCLA, a sub-regional RRO has been formed.

     


    The goals of the organization are consistent with collective management of reprography and ECCLA will, as a representative of authors and publishers from the OECS Member States, serve rightsholders, users and society at large by:

     


    (a)               Creating a compliance culture;
    (b)               Securing a healthy print and publishing market;
    (c)                Encouraging and protecting creativity; and
    (d)               Promoting national culture and cultural diversity.
     
     
    Mission

     

    To protect and remunerate owners of copyrighted works by establishing legal access through a comprehensive system of licences to key sectors of the community, including primary and secondary educational institutions, post secondary educational institutions, the Governments of the OECS Member States, copyshops and private corporations.

     

     
     
     Objects

     

     
    The business of the Association includes, inter alia, the following objects:

     

     
    (i)                 To protect and advance the interests of authors and publishers who have legal rights in copyright works which are subjected to copying by photocopying, database storage and retrieval and other forms of reprography, non-dramatic performance, dramatic performance for educational purposes, and analogous forms of reproduction.

     

     
    (ii)              On behalf of authors and publishers, to facilitate authorized public access to copyright works in particular by licensing reproduction and by collecting royalties on behalf of members and distribution of the royalties in accordance with the terms of any agreement with the members.

     

     
    (iii)            To consider or examine issues relating to reprography, digital copying and similar copying, and to educate and provide information to authors, publishers and users with respect to copyright issues.

     

     
    (iv)             To increase public awareness and understanding of copyright, including the collective administration of copyright and to promote compliance with copyright laws.

     

     
    (v)               To do all such other lawful things as are incidental or conducive to the attainment of any of the objects hereinbefore mentioned, provided that ECCLA shall not support with its funds any object or endeavour to impose on or procure to be observed by its members or to others any regulations, restrictions or conditions which if an object of ECCLA would make it a trade union.
