~~Adz:Left~~{Charlestown; Nevis} Three young women who fought at Price Busters, Ram’s Complex, Stoney Grove, Nevis on September 29th were found guilty of disorderly conduct yesterday and ordered by Magistrate Yasmine Clarke to pay $500 fines each.

Kimoyah Carey, Shaniqua Carey who were represented by Adrian Scantlebury and Sameka Reid, an employee at Price Busters who was represented by Collins Tyrell, are expected to pay the fine within three months or face one month’s imprisonment. They had been charged with disorderly conduct by fighting and malicious damage. Inspector Trevor Mills represented the prosecution.

The malicious damage charge was dropped.  According to defence lawyers, the prosecution failed to prove the defendants’ malicious intent to damage show glass cases. General Manager at Price Busters, Vinod Parmanan, said it would cost Price Buster EC$5000 to replace the cases.

Prior to reading the sentence, Magistrate Clarke cautioned the young women: “If you get a criminal conviction you cannot get a US visa. You are young, if you pay the fine, there will be no conviction. If the fine is not paid, there will be a criminal conviction,” Clarke said.

The magistrate further told them, that their behaviour on September 29th was not acceptable. She said the first person to be hit should have reported the matter to the police station instead of fighting: “Somebody who was hit could have gone to the police station.”

According to Kimoyah and Shaniqua’s testimony, who are sisters, they went to Price Busters on September 29th to check on a friend. Shaniqua told Kimoya, “that is the girl who calls my phone and curses”. Apparently, Kimoyah walked close to Sameka and told her, “can I ask you a question?” Kimoyah requested Sameka to get away from the people so the question could be asked in private.

According to testimonies and during cross-examination the issue surrounding the two sisters’ visit to Price Busters and the ensuing fight involved an unidentified boyfriend.

The General Manager, Price Busters, Parmanan had called the police after he and shoppers had tried to separate the trio. According to the arresting officer, Corporal Errol Hobson, the trio wanted to continue fighting while in the police vehicle and had to place Sameka in another police vehicle.
