No Boundary changes in St. Kitts and Nevis

    Commission Report Quashed By High Court Judge

     

    BASSETERRE, ST. KITTS, July 31st, 2014 (TUCOM)   --  The illegitimate and desperate Denzil Douglas administration was dealt a massive blow today when a High Court Judge rejected its latest attempt to change the electoral boundaries in St. Kitts and Nevis.

    In a 74-page judgment, in what has been popularized as the election boundaries case, Justice Darshan Ramdhani quashed the decision of the Constituency Boundaries Commission (CBC) chaired by Peter Jenkins, declaring its (5th September 2013) report “ultra vires, null and void and of no effect.”

    Dr. Douglas and Sir Edmund Lawrence have been restrained by the Court from doing anything with the said report, after Justice Ramdhani issued orders: 1) prohibiting the CBC from submitting the report to the Governor General or otherwise making use of the report; 2) prohibiting the (illegitimate) Prime Minister Douglas from submitting the draft proclamation, approved by Parliament on 9th September 2013, to the Governor General; and 3) prohibiting the Governor General from making any proclamation to change the boundaries.

    This is a big victory for the people and for democracy in St. Kitts and Nevis. This long fight, led by Team Unity on behalf of the people and their desire to preserve and protect democratic governance, has once again been vindicated by the Court.

    We thank our legal team, headed by Senior Counsel Douglas Mendes, and all who supported the cause for democracy, whether financially, morally or prayerfully. Thousands of our citizens have been praying that justice will be delivered and today, justice Ramdhani delivered justice to the people.

    We are advised that Justice Ramdhni’s tenure in St. Kitts and Nevis is now ended and we of Team Unity, on behalf of the people, wish him well in his future endeavours. He has been a shining light of courage and integrity and his meticulously chiseled intellect has redounded to the benefit of our country, our democracy and our people.

    This year, two fundamental threats to our democracy have been averted due to the intervention of the Court. Firstly, in the motion of no confidence (MONC) case, the Judge found that the Douglas administration’s right to govern in the current circumstances is invalid and now the second effort to steal the elections, by manipulating constituency boundaries in an unfair way, has been stymied.

    The people of St. Kitts and Nevis deserve better…better government and better governance. It is now time for this illegitimate Douglas administration to do right by the people and call fresh elections. Let the people determine their destiny. Give them the opportunity to choose hope over despair…let them choose decency over vulgarity…let them choose an agenda for prosperity over galloping poverty…let them choose democracy over autocracy.

    Today, a Court of Law expressed a clear judgment on boundary changes proposed by a minority government, desperate to stay in power to continue its selfish agenda. Now, it is time for the “court of public opinion” to be expressed in the election of a majority Team Unity government that is ready to serve the people’s agenda.
