    Friday, October 24, 2014 - The Licensing Magistrate will hold a special sitting for the hearing and determining of applications for the issuance of and renewal of Liquor Licenses on Monday, December 1, 2014 at 10:00 a.m. at the Magistrate’s Court in John’s Hole.

     

    Anyone wishing to apply for a license for the sale of intoxicating liquor is required to serve a notice in writing on the Licensing Magistrate, the Commissioner of Police, the Commissioner of Inland Revenue, the Chief Fire Officer, the Chief Environmental Health Officer, Director, Trade and Consumer Affairs, and Chief Planner, fourteen (14) days prior to the hearing. The notice must declare his or her intention to make such an application. The application must also be published in a newspaper in the Territory and the publication brought to the sitting as proof of the applicant’s publication of the application.

    New applicants are also required to be in possession of valid trade licenses to operate in the manner they propose to be licensed, and some new applicants may need development planning permission to operate at the location from which they propose to operate and the premises may need to be inspected by the Fire and Rescue Services Department.  Therefore, new applicants are asked to make inquiries with the Virgin Islands Fire and Rescue Services, Department of Trade and Consumer Affairs and the Town and Country Planning Department on these issues.

     Additionally, persons wishing to renew their applications should submit their applications along with a copy of their valid current trade license before the licensing day, copies of the same should also be served on the Commissioner of Police and Commissioner of Inland Revenue.  Also, please note that where a third party desires to execute a renewal application on behalf of another, that third party is required to submit proof of his authority to act for the applicant along with the executed renewal application.

    Anyone who wishes to object to the granting of a license to a new applicant shall attend the Special Sitting and voice their objections.  Persons wishing to object to the renewal of a license must serve written notice of such intention to object, which must be served on the holder of the licence and the Licensing Magistrate seven (7) days before the licensing day. A form for making an objection is available for collection at the Magistrate’s Court.  A copy of the notice of objection should also be served on the Commissioner of Police and the Commissioner of Inland Revenue.  The person objecting to the renewal of a licence is required to attend the special sitting on the licensing day.

    Licensees who have failed to apply for renewal at a previous sitting on which date their licences had expired, those licences have lapsed and those persons are required to apply as a new applicant.

    Licensees with outstanding fees for licences will not be considered for renewal until those fees have been paid in full.  Such payments must be made to the Department of Inland Revenue before the licensing day.  The list with arrears has been prepared and is available for viewing at the Magistrate’s Court and the Inland Revenue Department.

    The application forms have been revised and are available at the Magistrate’s Court Offices at John’s Hole, Tortola and the Valley, Virgin Gorda as well as at the Inland Revenue Department, located in the West Atrium on the ground floor of the Central Administration Complex.
