Another Major Court Loss for Dr. Douglas

Press Release (TUCOM)

Basseterre, St.Kitts (TUCOM):- The minority Dr. Denzil Douglas regime has again been served up another devastating blow in the courtroom.

Chief Justice Her Ladyship Janice Pereira along with the other Honorable appellate Justices today dismissed the appeals of both the Speaker of the National Assembly and Attorney General to have the Opposition’s Motion of No Confidence case removed from the courts.

The Opposition sought the court’s relief since April 2013 to have the Motion, filed December of 2012, put on the Order Paper and debated as a matter of urgency. PM Douglas, facing certain defeat if the motion were to be voted on, has found every avenue to delay its tabling.

His last attempt was to have the Speaker and Attorney General file appeals against the trial judge’s decision in February that the case should proceed to trial. Now that too has been struck down by the Court of Appeals as being clearly frivolous as there is a serious issue to be tried.

Significantly, the Speaker and the AG have been ordered to pay costs to Opposition MPs at an amount to be agreed upon within 30 days.

The Learned Chief Justice expressed the view that the matter, being critical in nature, should be heard expeditiously. She instructed the Speaker and Attorney General to file affidavits within 21 days.

Most crushing to PM Douglas and his continued effort to delay the Motion of No Confidence was the Chief Justice’s order that a date be set for the next steps in the matter no later than December 1st.

Citizens have complained that every single time PM Douglas and his team file applications and appeals, their cadre of lawyers, including Lord Peter Goldsmith QC former Attorney General of the United Kingdom, collect handsome legal fees. This wanton wasting of money to subvert established democratic processes has incensed observers while school children and teachers fall ill at the Nation’s largest learning institution. Millions of taxpayers’ dollars are being spent to frustrate and subvert the democratic processes of the Nation while the ordinary people continue to struggle to make ends meet on a daily basis.

Poll after poll has shown that PM Douglas has long passed his sell-by date but he refuses to accept the resounding call of the people to let the people with the ideas to improve the lives of the citizens take the reins and steer St. Kitts and Nevis back on a path of decency, democracy and prosperity.
