Injunction hearing set for Wednesday

    BASSETERRE, St. Kitts – THIS morning (Feb. 2) the Eastern Caribbean Supreme Court (Court of Appeal) rescheduled the injunction appeal case for Wednesday (Feb. 4).

     

    A request for rescheduling was made by the Government late last week. According to Prime Minister the Rt. Hon. Dr. Denzil Douglas, having it heard on Monday (Feb. 9), three days after Nomination Day, would have led to administrative complications.

    The Government’s application was heard this morning via teleconference and, according to information reaching SKNVibes, the Appellate Court’s decision was made with the consent of all parties involved.

    The hearing is set to begin at 10:00 a.m. in St. Lucia and counsel involved in the matter would be travelling to that island.

    The injunction matter stems from the events of January 16, 2015. According to the Opposition, the Government had hurriedly laid the Constituency Boundaries Commission’s final report before the Federal Parliament which sanctioned it, had it immediately signed by the Governor-General and gazette, and the Prime Minister shortly thereafter dissolved the Parliament.

    The Opposition secured an injunction on the same evening by Justice Marlene Carter but she eventually overturned it.

    The Opposition filed to appeal her decision and asked the Appellate Court for an interim injunction preventing use of the new boundaries, which was granted.

    The case is of paramount importance and is of a historic nature, because it will determine how the February 16 General Elections will proceed.

    Both the Government and the Opposition have expressed their confidence that the Court would agree with their arguments and rule in their favour.
