Three to be sentenced tomorrow at High Court

    BASSETERRE, St. Kitts – THREE men, Carl Warner, Neil Harvey and Joseph Gardener, who were found guilty on two separate charges by a 12-member jury, will finally learn of their fate tomorrow at the Basseterre High Court.

     

    The sentencing hearing of the men which was postponed last week and rescheduled for today (June 27) was again postponed for various reasons and will be heard tomorrow.

     

    Attorney John Cato, who is representing Carl Warner, said that he only learnt of the sentencing this morning and that Senior Counsel Dr. Henry Browne is to make mitigation’s on behalf of his client and had not been informed.

     

    Warner was found guilty by a 12-member jury for indecently assaulting a 23-year-old woman at his home in Lodge on August 28, 2010.

     

    Neil Harvey and Joseph Gardener were on Thursday (June 2) at the Basseterre High Court found guilty of wounding with intent but not guilty of unlawful wounding of a man in Dieppe Bay.

     

    When asked at their sentencing if there was any character witness to speak on their behalf, both men answered in the affirmative. However, Gardener’s witness was not present in court on that day and Harvey said that his mother had to go to the hospital.

     

    High Court Judge, Justice Errol Thomas then decided to postpone the sentencing until Today and said that the three men should have had everything in order by then.

     

    Harvey and Gardener were convicted of wounding St. Clair Elliott at an event held at Beaumont Park on April 5, 2010 and are both self-represented.
