    Bernell ‘Dan’ Duncan sentenced to nine years for attempted murder

    BASSETERRE, St. Kitts
    - A three man/nine woman jury was unanimous in their decision that Bernell ‘Dan’ Duncan is guilty of attempting to take the life of Earlston Warner.

    The case, presided over by His Lordship Justice Francis Belle, began on Monday and saw evidence being given by a number of prosecution witnesses including the virtual complainant, Warner.

    Warner, in his testimony, told the court that on the afternoon of August 5, 2005 at Sir Gilles Mountain, Sandy Point, the accused shot him in his chest with a fish gun and proceeded to hack away at his body with a cutlass. 

    Warner also testified that sometime during the onslaught he managed to flee for his life and got assistance in treating his injuries.

    Duncan, who opted to take the witness stand when presented the opportunity, endeavoured to convince the jury that he was not at the scene of the crime as Warner testified.

    “The jury did not believe you. I did not believe you,” Justice Belle told Duncan before passing sentence. His Lordship also told the convicted man that the incident was a “vicious attack”.
     
    And in making reference to his seemingly interminable criminal record, Belle expressed that anyone who would have gone to court on as many occasions as Duncan, would have, by now, taken stock of and changed their ways. ~~Adz:Right~~

    His Lordship Belle, having taken into consideration that Duncan was on remand for approximately one year before his trial, sentenced him to serve nine years at Her Majesty’s Prison (HMP).  He also told Duncan that he would serve his time in prison with hard labour.

    Shortly after, Duncan was escorted from the court to Cayon Street, Basseterre where he will be confined within the four familiar walls of HMP.

    Justice Belle dismissed the “wounding with intent” and “unlawful wounding” charges brought against Duncan.
