(Charlestown, Nevis)- Dwayne Freeman, a Rawlins resident was yesterday sentenced to five years imprisonment after being found guilty of “possession of ammunition and controlled drugs”.

Sixteen rounds of ammunition and a quantity of Cannabis were discovered in the defendant’s home during a Police search in December 2007.

Freeman pled guilty to the “possession of a controlled drug” but claimed innocence regarding the ammunition found on his premise.

According to the particulars of the case, Police Officer Joel Caines executed a search warrant at Freeman’s home and discovered the Cannabis. The ammunition, it was claimed, was found wrapped in tissue paper and concealed in a six-foot long hole hidden behind a board of the house.

Freeman and Watisha Browne were arrested and charged for the offences having been present in the home at the time of the discovery.

Browne saw her charges dismissed on Wednesday after her attorney Chesley Hamilton successfully argued that the woman had no prior knowledge of the presence of the drugs and ammunition. ~~Adz:Right~~

Freeman’s attorney put forth the same defence regarding the ammunition, claiming that about 10 people had access to the premises where his client resided. He also submitted that his client “was not in control of the items and anyone could have placed the items in a concealed position”.

Johnson also contended that the items could have been in that concealed position for any length of time unbeknownst to his client.

Magistrate Yasmine Clarke disagreed with the defence attorney’s submissions and sentenced Freeman to five years imprisonment for possession of the ammunition and one year for the Cannabis; sentences to run concurrently.

Following the sentencing, Freeman’s attorney spoke with SKNVibes.com articulating that the defendant ought not to have been convicted.
“The evidence was not sufficient to sustain a conviction.”
