Two plead guilty as January Criminal Assizes 2012 opens

    BASSETERRE, St. Kitts – A total of 34 cases are scheduled for the new January 2012 Criminal Assizes that began today (Jan. 17).

     

    Out of the 34 cases, 17 of them are new matters and at the end of the arraignment session, two of the matters resulted in guilty pleas.

     

    Douglas Anniel pleaded guilty to indecently assaulting a certain male on June 4, 2011 in Basseterre; he also faced another indecent assault charge of a certain male this time occurring sometime between July 11-31 2010 in Basseterre.

     

    Anniel is unrepresented by counsel and was told by His Lordship Justice Errol Thomas that he would be remanded into custody as he awaits his sentencing which will occur sometime during the assizes.

     

    Kervin Bergan also pleaded guilty to building breaking and larceny of a number of beverages from Inons Bar at Frigate Bay Beach including one case of Black Label, one case of Beehive, one case of Ponche Kuba, one case of red wine, one case of Blunt, all to the total value of EC$685 - all belonging to Vernon Nias.

     

    He, too, was told by His Lordship that he would be sentenced sometime during the assizes.

     

    The list also contains nine other sexually related crimes including five indecent assaults, two unlawful carnal knowledge cases, one rape and one incest matter.

     

    There are also six murder cases. In addition to those traversed Kelroy Hazel and Jahari Bart are jointly charged with the murder of Laustin Jamie Williams occurring on April 6, 2011.
    They both pleaded not guilty to the crime.

     

    Nelson Challenger, Shenroy Francis, Jami Rawlins, Glenroy Smithen and Moses Gardener are all jointly charged with the  murder/manslaughter of Gregory Zakers on April 10, 2008 while Amal Whyte and Devon Fyfield are yet to have their June 23, 2005 murder case involving Hubert Phipps tried.

     

    Jahdell Browne is facing two counts of murder and wounding with intent charges of John Napier and Sylvester Harris both incidents occurring on Sunday, October 25, 2009, at Miliken Estate; and also the wounding of Wilfred Simmonds.

     

    Amal Whyte and Devon Fyfield are jointly charged with the murder of Hubert Phipps on June 24, 2005, Denver Fyfield is charged with the murder of Hendricks Roberts who was killed sometime between June 20 and June 21.

     

    Finally, Melvina Kelly is also charged with the July 11, 2010 murder of her eight-year-old granddaughter, Belisha Edwards.

     

    Trelston Casey is charged with housebreaking and larceny at the Basseterre home of Symone Amos on October 11, 2010, where he stole one compact black laptop valued over EC$3,000.

     

    He was also charged with receiving the said computer and pleaded guilty for both charges.

     

    Exzavier Elliott and Junior Stevens are facing one count of robbery and three counts of assault with intent to rob which all occurred on July 1, 2010.

     

    On the first charge they were said to have stolen a number of items including a driver’s license, cell phone and pendant all to the total value of EC$2,468.20 belonging to Errol Finch.

     

    They are both charged with assault with intent to rob Neresha Francis, Lorna Wilson and Kieb Armstrong all on July 1, 2010 in Basseterre and pleaded not guilty to all counts.

     

    Joseph Harvey pleaded not guilty to wounding with intent Richard Mitcham at Lynches Mountain on March 3, 2011 and also unlawful wounding of Mitcham on the same date and place.
    He pleaded not guilty to both charges.

     

    Randale Hanley faces a burglary charge which occurred April 27, 2009 at the home of Rickford Hallequin and stole a number of items costing over EC$4,000. He was also charged with receiving those items and pleaded not guilty to both charges.

     

    Darren Patrick is charged with wounding with intent and a second count of unlawful wounding of Samuel Smithen on December 6, 2010 in Tabernacle.

     

    David Payne and a juvenile are jointly charged with robbery of St. Clair Nathaniel Gumbs at New Road on May 20, 2011 of a sum of money to the total of EC$647.
    They both pleaded not guilty.

     

    Elvis Bradshaw is facing a wounding with intent charge of Darren Hendrickson in Basseterre on February 9, 2011 and also unlawfully wounding Hendrickson on the same date and vicinity. He pleaded not guilty to both charges.

     

    Xavier Phillip and a juvenile are both charged with two counts of shooting with intent occurring on January 19, 2011 at Canada Industrial Site where they discharged a firearm at Alphonso Browne and Julian Charles.
