Brothers appealing murder convictions

Warrington Phillip and Gregory Che Spencer a.k.a. Duck Foot

    BASSETERRE, St. Kitts – BROTHERS Gregory Che Spencer a.k.a. Duck Foot and Warrington Phillip will both be going before the upcoming Eastern Caribbean Supreme Court of Appeal to appeal against their murder convictions.

     

    Spencer will be going before the Court of Appeal for the first time while Phillip has had his case adjourned from previous sittings.

     

    Spencer will be appealing against his conviction of the murder of Jason ‘Warlo’ Marsham while his brother  Warrington will be appealing the guilty verdict of murdering his wife of four years Shermel Phillip.

     

    The brothers who appear to be about several months apart in age both committed their murders at the age of 42, and their victims were both 27 years of age.

     

    According to a previous report, the evidence presented in court against Spencer showed that he murdered Marsham on December 6, 2006, just outside his Godwin Ghaut home. The witnesses told the court that Spencer and three other individuals (Valmon ‘John’ Williams, Canta Bowry and Devon ‘Pacal’ Henry) journeyed to Marsham’s residence on December 6, 2006 and summoned him outside. They further claimed that while Marsham and Pacal were speaking, Spencer told him [Marsham] there is something in his vehicle that belonged to him and he needed it.

     

    The prosecution witnesses said there was an exchange of words and Marsham had two bottles and was advancing towards Spencer when his sister, Rosalyn Marsham, decided to stand between the two men. The witnesses also claimed that Marsham did not use the bottles during the confrontation.

     

    Spencer, as the prosecution’s case outlined, hoisted his shirt, removed a firearm and fired a shot at the deceased which caught him on the forehead and a second one that struck him in the chest.  Prosecution witnesses further said that Spencer made his escape through some bushes while Williams went down the road on foot and the other two boarded the vehicle and left the scene.

     

    Meanwhile, Phillip had his case adjourned from previous court of appeals because prosecutors were unable to present arguments in the matter due to the illness of Barbadian Prosecutor Sir Richard Cheltenham.

     

    After a two-hour deliberation, a six-male/six-female had found the 42-year-old former Nevis and Leeward Islands cricketer guilty of killing Shermel Phillip (27).

     

    He was then sentenced to life imprisonment by Her Ladyship Justice Ianthea Leigertwood-Octave on Monday, December 22, 2008 at the Charlestown High Court.

     

    Phillip was arrested and charged on Tuesday, February 20, 2007 with the murder of his wife, whose body was discovered by neighbours in her car with multiple injuries at her Brown Hill, residence in Nevis on Friday, February 16, 2007.

     

    They were both represented by Senior Counsel Dr. Henry Browne during the trial.
