BASSETERRE, St. Kitts - TODAY (July 23) Marlon Kelly will be walking out of Her Majesty's Prison a free man, having been given a non-custodial sentence after pleading guilty to burglary.
Kelly appeared before His Lordship Justice Errol Thomas last Thursday (July 19) at the Basseterre High Court for sentencing after completing a Social Inquiry Report (SIR).
Kelly was charged with burglary, an offence that was said to have been committed at Boyds on January 12, 2010.
He had originally pleaded guilty but, on the day his case was scheduled to be tried, changed his guilty plea to not guilty.
At sentencing, the 30-year-old was unrepresented and did not call anyone to speak on his behalf.
Kelly's Social Inquiry Report (SIR) described him as a hard-working, quiet individual who suffered some memory loss and speech impediment due to a previous accident.
His Lordship gave Kelly a conditional discharge where he would be released from prison on July 23.
The conditions are that Kelly is not to commit any offences for one year, and if he does, he would immediately be arrested and brought back before His Lordship and he would be given a prison sentence for this offence.
"The Court is giving you a chance to rehabilitate yourself," the Judge said.
