    ROADTOWN Torotla BVI, October 30th, 2012 - The Domestic Violence Act, 2011, which will strengthen Government’s commitment to reduce family violence, will take effect on Wednesday, October 31, 2012 which coincides with the end of Domestic Violence Awareness month.

     

    His Excellency the Governor, Mr. Boyd McCleary, CMG, CVO under Section one of the Domestic

     

    Violence Act, 2011 has declared that the Act will come into force on this day. The new provisions declared in the Act will allow police officers to respond to all complaints, or reports alleging domestic violence whether or not the complainant is the victim.

     

    Additionally, the Act gives police officers a duty to inform both victim and perpetrator of their rights. Furthermore, they can arrest, without warrant, persons suspected of domestic violence.  As part of the process, police officers must also complete a domestic violence report as part of a Domestic Violence Register to be maintained by the Commissioner of Police.

     

    An application for a protection order may be brought on behalf of the victim by any person, including a police officer or an approved social worker who has a material interest in the well-being of the victim.

     

    Gender Affairs Coordinator, Ms. Lorolie Connor is delighted with the enactment. She told the Department of Information and Public Relations, “It should be a great difference in the way we view domestic violence since it includes areas that are modern such as use of electronic mail and stalking.”

     

    She added, “I am also pleased that we are following the regional standard because this is the model from the OECS Family Legislation with minor amendments, so I am delighted to know that it is now enacted.”

     

    The Domestic Violence Act, 2011 broadens the definition of domestic violence to include: economic abuse, intimidation, harassment, stalking, and damage to and destruction of property while offering protection to persons in visiting relationships.

     

    The Ministry of Health and Social Development aspires to provide leadership that promotes health, social wellbeing, and a safe environment as positive resources for living and sustainable development of the Territory.
