Sentencing postponed...again

    BASSETERRE, St. Kitts - TWO young men who were supposed to be sentenced on January 30, would have to wait another week before knowing their fate, as the sentencing hearing which was rescheduled for yesterday (Feb. 20) was again postponed.

     

    The men are Jesse Fyfield and Paul John, who pleaded guilty to housebreaking, larceny and receiving stolen goods on January 14.

     

    They were said to have broken into a Shadwell home in September 2012, stealing approximately $45 825 worth of items which included money, a cellular phone, jewellery, clothing, perfumes and electronics.

     

    Although no reason was given for the postponement, their sentencing was rescheduled for next week Thursday (Feb. 27), where they, along with others would learn of their fate.

     

    On January 30, the sentencing hearing for the duo came to a halt when it was discovered by His Lordship Justice Darshan Ramdhani that the unrepresented men were given copies of the case facts shortly before the Court was called into session.

     

    Justice Ramdhani had asked the men if they were aware of what the facts of their case stated to which they replied in the negative. 

     

    The judge had also announced that he too had only received his copy five minutes after the sentencing was scheduled to begin.

     

    Addressing the prosecution, he stressed on the importance of having the paperwork prepared and distributed in a timely matter, stating that he requested the facts of the case be delivered to the men at least one week prior to the sentencing date, providing them with enough time to review it and prepare themselves.

     

    He highlighted some inefficiencies within the document and ordered that it be redone and completed by today (Feb. 21), adding that the Court is the one that would be held accountable if there is any injustice.

     

    He said the facts differ for each men and should be separated so that it clearly states the circumstances for each of them surrounding the incident. He also ordered that the men be presented with those facts in due time.

     

    It was rescheduled for February 6, but could not have been heard due to the local sitting of the Eastern Caribbean Supreme Court of Appeal.
