Woman acquitted of drug bust charges

    BASSETERRE, St. Kitts – EVELYN NISBETT, the Nevisian young lady who was charged in April, 2014 with drug possession after a drug bust at Port Zante, was acquitted last evening (Sept. 30) following a court hearing at the District ‘A’ Magistrate’s Court.

     

    The Shaw’s Road, New Castle resident was charged in early April with possession of cannabis and possession of cannabis with intent.

     

    Reports then, indicated that a vessel – the Nevisian Spirit – was docked at the Port Zante Marina when Police Force and Defence Force officers as well as officers of the Customs Department boarded the vessel and found two bails of marijuana.

     

    The allegation was that the vehicle which Nisbett drove, was that which was used to deliver the package to the Nevisian Spirit.

     

    In addition to Nisbett, Wasim Richards of Ramsbury, Damion Jeffers of Pond’s Pasture, Jermaine Pemberton of New Castle, Kemroy Simmonds of Hermitage Village and Robert Gregory Roberts of Stoney Grove were also charged.

     

    SKNVibes understands that as the matter unfolded, the case against four of the accused – including the vessel’s captain, was withdrawn.

     

    Nisbett - represented by Glenford Hamilton of Hamilton & Co and his junior Karene Paul – appeared before Her Worship Josephine Mallelieu-Webbe for her hearing which began on Friday (Sept. 26) along with Pemberton who was being represented by Dr. Henry Browne QC.

     

    This publication understands that a “no case” submission made by Dr. Browne on his client’s behalf was upheld by the court, which led to the case against him being dismissed.

     

    The Commissioner of Police was to have been summoned to give evidence at the hearing but he – according to information received by this media house – claimed not to have been served the summons to appear before the court.

     

    Nonetheless, Nisbett testified on her own behalf and so did her mother. And after a full trial, the case against her was also dismissed by Mallelieu-Webbe and she ordered that the vehicle which was confiscated from her by the police, be returned to her within 14 days, once the Crown is not appealing the matter.
