Appellate Court to hear Government’s application tomorrow

    BASSETERRE, St. Kitts - THE Eastern Caribbean Court of Appeal is slated to have a hearing tomorrow (Feb. 2) by teleconference to hear the Government of St. Kitts and Nevis’ application to have the injunction matter rescheduled to an earlier date.

     

    After imposing an interim injunction prohibiting use of the new constituency boundaries last week, the Appellate Court set a February 9 date to hear the substantive matter. 

    The hearing date falls three days after Nomination Day and, according to Prime Minister the Rt. Hon. Dr. Denzil Douglas, this would cause “administrative complications”.

    The Prime Minister said his Government has no difficulty waiting on the decision of the Court but because of the concern of possible administrative complications, his Government asked the Court to consider moving the hearing date so that is falls before Nomination Day on February 6.

    This is the application that the Court is expected to consider tomorrow via teleconference.

    According to the view expressed by Team Unity alliance member Hon. Shawn K. Richards during an interview with WINNFM, the Government is in the position it is in because of its own doing.

    He said the Government, by attempting to change the constituency boundaries in the manner that it did, sought to deny the Opposition of its constitutional right of access to the Court.

    Richards opined that the Government should not be granted a speedy hearing because it would not have been in this position had it allowed the Opposition to access the Court.
