BASSETERRE, St. Kitts – THE Eastern Caribbean Supreme Court will later today (Feb. 5) hand down its judgment on whether or not it will reverse the decision of the Basseterre High Court to discharge an injunction it had previously granted.
The case was heard yesterday in St. Lucia where counsel for the Opposition and the Government argued for and against reinstating the injunction.
The injunction was first given by Her Ladyship Justice Marlene Carter of the Basseterre High Court on January 16, 2015 to prevent use of the Constituency Boundaries Commission’s final Report to realign the boundaries.
The injunction was secured after the entire process of realigning the boundaries was completed.
She later discharged the injunction and the Opposition appealed her decision with the Appellate Court asking it to instate an interim injunction until the appeal of Her Ladyship’s decision is completed. That request was granted.
SKNVibes understands that, yesterday, the lawyers who reportedly began presenting their case at about 10:00 a.m. and broke for lunch sometime in the afternoon did not leave the Court until sometime close to 9:00 p.m.
The Appellate Court is expected to hand down its decision at 2:00 p.m. today.
