    BASSETERRE, ST. KITTS, JULY 24TH 2009 (CUOPM) – Eastern Caribbean High Court Judge, Her Ladyship, Rita Joseph Olivetti will on Monday, begin hearing Constitutional matters related to the recent passage of legislation in the St. Kitts and Nevis National Assembly.
     
    Justice Olivetti, one of two resident judges in the British Virgin Islands, is being asked by lawyers for the Constituency Boundaries Commission and the Attorney General, to set aside an application for Contempt proceedings brought by the Parliamentary Representative for Constituency #5, the Hon. Shawn K. Richards.
     
    During the Sitting at the Sir Lee Llewellyn Moore building, the Government’s Legal Team will also ask Judge Olivetti to set aside an injunction brought by Mr. Richards and his un-elected Political Leader, Mr. Lindsay Grant and also the setting aside of the application for judicial review.
     
    The Government’s Legal Team is led by Mr. Anthony Astaphan, S.C. and includes Dr. Henry Browne, Mr. Sylvester Anthony and instructing Solicitor, Mr. Gossai.
     
    Via teleconference, the Legal Team will also move the Eastern Caribbean Court of Appeal in relation to the injunction restraining the Constituency Boundaries Commission, from submitting its Report to the Governor General, which has already taken place.
     
    The government lawyers will also appeal an Oder to Dr. Henry Browne from Resident Judge, Mr. Francis Belle, requesting information via affidavit on what information he had provided to the Prime Minister.
     
    Also a second injunction obtained by Messrs. Shawn Richards and Lindsay Grant seeking to restrain the Supervisor of Elections and the Electoral commission from conducting any elections under the realigned constituency boundaries.
     
    Justice Joseph Olivetti will begin hearing the matter at 9 A.M.
