DPP takes over Dr. Drew/ Hamilton criminal case

    BASSETERRE, St. Kitts - THE Director of Public Prosecutions (DPP), Valston Graham, has taken over the criminal case brought by St. Kitts-Nevis Labour Party’s Chairman Dr. Terrance Drew against People’s Action Movement’s Eugene Hamilton, alleging, among other things, Bribery.

     

    Addressing the media yesterday (Feb.25, morning, Graham explained that he was only recently made aware of the charges brought against Hamilton, and at Monday’s hearing asked for the case to be stood down.

     

    He asked that the claimant, Dr. Drew, provides him with the necessary evidence to make the determination on the way forward with the case since, under the Constitution, the DPP has jurisdiction over the matter.

     

    The matter is expected to come up again on Monday (Mar. 1) at which point it is expected that the evidence will be provided.

     

    “Section 65 of the Constitution of the Federation of St. Christopher and Nevis places me as the custodial guardian and control of criminal prosecution in this Federation. I consider it to be inconceivable, absolutely nonsensical that the Director of Public Prosecution must sit back and allow a prosecution that alleges bribery against an elected official to be pursued in a private capacity,” explained Graham.

     

    He added: “Section 65 of the Constitution places me with control of criminal prosecution. Subsection 2B says that I can take over any prosecution instituted by any authority, and Subsection C says I can continue that prosecution or I can discontinue a prosecution.”
     
    In filing the charges, Dr. Drew alleges bribery and treating, the lead-up to the Federation’s 2020 General Elections, which saw the medical practitioner losing to Hamilton by less than 30 votes.

     

    Since Monday's announcement, the DPP has come in for heavy criticisms on social media by special media influencers.

     

    But Graham is not sitting back and taking those criticisms lightly, as he has come out and rubbished claims that his actions were influenced by political affiliation.

     

    He told reporters at his Basseterre office that he is “not a political pundit” and as such is brushing off suggestions that he has taken a political side.
