CHARLESTOWN, Nevis – A female resident of Bath Village appeared in the Charlestown Magistrate’s Court yesterday (Oct. 13) and was fined $500 after being found guilty of a battery charge.

Telisha Boston was convicted of the act committed on Abeana Tyson of Brown Hill on August 4 last.

Tyson told the court that around 9:20 p.m. on the day in question, she was walking in the vicinity of Independence Square and, as she stepped off the road onto the pavement, Boston put out her foot and kicked her on the right ankle.

The virtual complainant said she turned around and asked the defendant why she kicked her and Boston replied, “I did not kick you and if you bad do something about it.” Tyson then reported the matter to the Charlestown Police Station. Tyson said the only reason she brought Boston to court was to get some peace because she constantly interferes with her.

The court also heard from Moszella Tyson who corroborated Abeana Tyson’s claims of what occurred on August 4.

In her defence, Boston told the court that she was sitting with her son and two friends having a conversation. She said that she never saw Tyson until she turned around asking about a kicking incident. Boston also said she did not kick Tyson and made a comment to her saying, “If I kick you kick me back.”

Cleopatra Perry, a witness for the defence, told the court that she was seated with Boston and did not see her kick anyone.

After hearing the evidence, Magistrate Yasmine Clarke found Boston guilty and fined her $500 to be paid in three months, or one month in prison.

Boston appeared before the court in 2005 to answer similar charges and was also convicted and fined.
