CHARLESTOWN, Nevis – A MAN who is serving time for larceny and breaking and entering will have to wait until April 2010 to know his fate on another matter which is currently before the court.
James Ham, currently serving a six-month and two three-year sentences for the offenses, was yesterday (Nov. 12) ordered to remain in custody by Justice Ianthea Leigertwood-Octave after a 12-member jury failed to reach a verdict on charges of burglary and rape brought against him.
As a result of the hung jury, the matter will be brought up again at the next criminal assizes.
Ham, represented by Jason Hamilton, had pleaded not guilty to the offence which took place in Bath Village in January 2008. The defence claimed that sex was consensual.
Meanwhile, when the court meets again on Monday, it will hear the case against Duran Grant who pleaded not guilty to unlawful carnal knowledge.
