Hamilton says he never swore allegiance to US

    BASSETERRE, St. Kitts – PARLIAMENTARY REPRESENTATIVE for St. Christopher Eight, the Hon. Eugene Hamilton, said he had never sworn allegiance to the United States and has never denied having a US Permanent Resident Card, commonly called a ‘green card’.

     

    Hamilton was at the time responding to a press release issued by the Communication Unit of the Office of the Prime Minister (CUOPM), dated May 30, 2010 and headlined “Eugene Hamilton confirms he holds a US Green Card”.

     

    The release reads, “The People’s Action Movement (PAM) Parliamentary Representative for St. Christopher 8, the Hon. Eugene Alastair Hamilton is the holder of a United States Permanent Resident Card (Green Card). Mr. Hamilton made the disclosure in a court document filed in the High Court in response to an election petition filed by Mr. Cedric Liburd, his St. Kitts-Nevis Labour Party opponent in the January 25th 2010 general election.

     

    “Mr. Hamilton informed the Court that he is the holder of a United States Permanent Resident Card (Green Card). It confirms that he is a Resident of the United States from 9th July 2003 and that the card expires on 21st July 2013. The revelation confirms the contention by the Mr. Cedric Liburd that the Hon. Eugene Hamilton, has been travelling on a foreign travel document not issued by the Federation of St. Kitts and Nevis.”

     

    In an exclusive interview with SKNVibes on Monday, May 31, Hamilton opined that the Labour Party’s administration must have been taken aback by his action to confirm that he never travelled on a foreign document.

     

    “They must have been shocked and shattered over the last couple of weeks, because I filed a document in the court on May 11, 2010 and invited them to comply with the court order to take a look at my documents on Thursday, May 13, 2010. Today is May 31 and none of them had bothered to go and inspect the documents up to now.”

     

    The PAM’s MP noted that Liburd accused him of being the holder of a US passport but could not support his allegation with the relevant facts.

     

    “In the original petition, they claim that I have a passport…they claim that I have all kinds of things issued by the United States government. To this day, I had gone and put mine in the court and they have not yet shown the court what documents they say I have. So, to me, it’s just blowing hot air. They are blowing smoke in the wind, because I have never hidden the fact that I have a green card. But I am going to say categorically that I have never had allegiance, obedience or adherence to any foreign power or state. I still maintain that.”

     

    The CUOPM’s press release also states that Liburd contends that Hamilton, as an adult, “applied for, accepted and travelled on foreign travel documents or papers issued by the government of the United States and that the acquisition of a foreign document (including a green card) and or passport of the United States required him to swear to an oath of allegiance and or acknowledge his allegiance to a foreign state or power, namely the United States”.

     

    Additionally, Liburd claims that several times in 2008 and 2009 Hamilton had travelled from the Federation to the United States to Miami and Puerto Rico on documents that were not issued by the Federation of St. Kitts and Nevis, but by a foreign power or State, namely the United States of America.

     

    Hamilton however stressed that being the holder of US Permanent Resident Card does not make an immigrant obedient to the US and that he does not have a US passport.

     

    “Having a green card does not make me obedient or have allegiance or adherence to the United States. I do not have a United States passport and I never had one! Even to refer to a travel document, as they did, is such a misnomer; for a green card can take you nowhere. You cannot travel on a green card…you have to get a special permit to enter the United States if you stay out of that country too long with their green card.
    “But, whatever they are aiming to do, they are all going to fail. I guess harassment is one of the things they are aiming at, or they are trying to make their supporters in Constituency Number Eight feel good about something.”

     

    Hamilton pointed out that it is a well established fact that a US Permanent Resident Card does not reach the level of having obedience, allegiance or adherence to the US.
    “As a matter of fact,” he added, “a green card holder cannot vote in the United States, or can a green card holder work for the federal government in that country.”

     

    On the other hand, Liburd is claiming that on Nomination Day, Hamilton was still a citizenship of or under an acknowledgement, obedience and or adherence to the US. He also claimed that Hamilton had never produced any certificate of renunciation issued by the State Department or other relevant authority of the US, as is required by and under the laws of that country.

     

    The release states that the former MP “prays for a determination that the nomination of Mr. Hamilton is invalid, null and void and no legal effect; that he was not qualified and was disqualified from being elected and that his election as a Member of Parliament be declared null and void and that the Petitioner (Mr. Cedric Liburd) was the only duly qualified and validly nominated on Nomination Day and was and is entitled to be returned to the National Assembly as the duly elected Member of Parliament”.
