The governing St.
Kitts-Nevis Labour Party said Friday its is "extremely pleased with the outcome of the No. 4 Constituency 2004 Election Petition case brought against the Hon. Rupert Herbert of the St. Kitts-Nevis Labour Party, and Pastor Leroy Benjamin, the Supervisor of Elections, and Mr. Wentford Rogers, the Returning Officer.
Last week, Resident Judge His Lordship Mr. Justice Francis Belle of the Eastern Caribbean Supreme Court dismissed the election petition brought by Mr. Lindsay F. Grant, the Leader of the Peoples Action Movement (PAM), who contested the General Elections of 2004 for Constituency No. 4.
"Mr. Grant, who was roundly defeated by the Hon. Rupert Herbert in the Elections of 2004 sought to overturn the results of the Election and attempted to frustrate the wishes of the Electorate of Constituency No. 4 by his application to the Court," a statement issued by the Party Secretariat said.
The Party Secretariat said the ruling of the learned Judge, "confirmed the re-election of Hon Rupert Herbert, of the Labour Party as the Parliamentary Representative of Constituency No. 4; confirmed that the majority of voters in Constituency No. 4 voted against Lindsay Grant and PAM, and thus confirmed their defeat; upheld the decisions taken by the Supervisor of Elections and other Election Officials on matters related to certain voters whom Lindsay Grant and PAM sought to disenfranchise and who were qualified and had the right to vote under the Constitution and the Electoral Laws of the Federation of St. Kitts and Nevis and under which the 2004 Elections were conducted."
The St. Kitts-Nevis Labour Party in congratulating Mr. Herbert again for his outstanding third successive victory at the polls and in the Eastern Caribbean Supreme Court, said that as the party of majority support in St.
~~Adz:Right~~Kitts and Nevis, it thanks all the defence lawyers and the Election Officials who have been vindicated by the ruling of the Judge.
The Labour Party also commended the Constituency No. 4 Branch Executive and all Election Day Workers for a successful 2004 campaign that resulted in the re-election of their candidate.
