BASSETERRE, St. Kitts – A 12-member jury at the Basseterre High Court on Thursday (Feb. 17) had unanimously found a young man guilty of larceny and not guilty of house breaking and larceny.
Marvin Whyte was found guilty of breaking into the home of Sylvester Francis of Basseterre and stealing a number of items on August 4, 2009.
The prosecutor told the court that Whyte broke into Francis’ home and stole an X-box, a portable DVD, a digital camera, three cellular phones, one maroon Kipling bag and one black Jansport bag, all to the value of EC$6,285.60.
Three witnesses had testified including the virtual complainant, who told the court that he saw the accused walking by The Circus with a Jansport bag that looked like the one owned by his son.
Francis said his son had told him of certain markings on the bag and, after walking behind the accused for three minutes and observing the bag, he decided to call the police.
The bag found on Whyte was brought into evidence and Francis told the court that it contained compass markings on the inside, which had proven to be true.
His Lordship Justice Errol Thomas told Whyte that he would be detained until Thursday March 3, 2011 for sentiencing.
