January Assizes ends; 16 criminals to serve 137.5 years

    BASSETERRE, St. Kitts – THE January Criminal Assizes has ended and many residents are pleased with the outcome of most of the cases and sentences handed down by His Lordship Justice Errol Thomas, especially to those unscrupulous men who had robbed young girls of their childhood.

     

    Among the 42 cases tried at the Basseterre High Court, there were 16 convictions with sentences totalling 137.5 years of which 112 were for rape, unlawful carnal knowledge and entering a dwelling house with intent to rape.

     

    Troy Hendrickson, Craig Bradshaw and Keithly Griffin were each sentenced to 20 years for unlawful carnal knowledge, while David Morton and Emmanuel Mills were sentenced to 18 and 21 years respectively for rape. Fitzroy Challenger has to serve three years for entering a dwelling house with intent to rape.

     

    However, in addition to Mills’ 21-year rape sentence, he has to serve five years for burglary and two-five-year concurrent sentences for two counts of assault with intent to rob.

     

    Many law abiding nationals and residents of St. Kitts and Nevis have either voiced or penned their opinions on the sentences meted out to these convicts and were high in praise of Justice Thomas.

     

    One individual said, “Where had he been all these years? He is the right person for the job of making these vagabonds pay for their crimes against humanity and to understand that children are not adults.”

     

    A middle-aged man, who gave his name as Leroy, said, “It is very hard to believe that grown men are taking advantage of innocence.
    What pleasure can they get from a child? Have they ever given thought of their young girl children, sisters or other close relatives when they are performing this unscrupulous act against somebody else’s child? I am so sorry that the maximum penalty is not death by hanging, because these men have killed the innocence within those children.”

     

    A review of the comments posted by this media house suggests that Justice Thomas should also show no mercy on all those who appear before him charged with gun-related crimes.

     

    Meanwhile, 18 of the 42 cases were traversed to the Assizes, four ended in not guilty verdicts, one was deemed a mistrial, one saw the accused freed on nolle prosequi application by the Director of Public Prosecutions, and two ended in hung jury. 

     

    Among the remaining cases, Jermaul Jules was sentenced to six years for robbery, Talbert Warner four years for larceny and embezzlement, Asgarilli Rogers two years for receiving, and Leslie Farrell sentenced to five years for robbery and unlawful wounding.
    Additionally, Carlyle Liddie received three years for breaking and entering a dwelling house, James Hodge got four years for indecent assault and Marvin Whyte sentenced to 18 months for larceny.

     

    Esha Browne and Amare Browne, who were found guilty of fraud, were both given suspended sentences as well as Dion ‘Ayatollah’ Stevens, who was convicted for building breaking and larceny, while Sylvester Allen was fined for causing death by careless driving and also had his license suspended for a year.

     

    The four cases that ended in not guilty verdicts were that of Lenny Liddie and Gavin Boddie who were jointly charged with robbery, Mandefro Roberts who was charged with fraud, Sheldon Augustus who was charged with indecent assault, and Julian Benjamin was acquitted of unlawful wounding and wounding with intent.

     

    The 18 traversed cases are those of Ike Dias, who was charged with breaking and entering; Calvin Samuel and Alexis Hodge, who are jointly charged with house breaking and larceny; murder accused Delvin Benjamin; renowned educator Newrish Nital, who is facing charges of fraud and false pretence; Dennis Doras on larceny charges; and Nelson Challenger, Shenroy Francis, Jami Rawlins, Glenroy Smithen and Moses Gardener, who are jointly charged with murder and manslaughter.

     

    Amit Sahajwala is facing embezzlement charges, Baba Tunde Dami Lola Alonge is charged with fraud and false pretence, Devon Ryan is facing attempted murder charges, and Amal Whyte and Devon Fyfield were both charged with murder.

     

    The other traversed cases are those of Curtlee Rogers and Alpha Duporte, who are jointly charged with murder; Jahdell Browne, charged with murder; Sheldon Maloney, charged with indecent assault; Razba Matthew, charged with manslaughter; Denver Fyfield; charged with murder; Jervin Dowell, charged with house breaking and larceny; Devon Williams, charged with causing death of another; and Melvina Kelly, who is charged with murder.

     

    The two hung jury cases involved Dwight Peets, who was charged with indecent assault, and Leon Clarke, who was charged with entering a house with intent to commit unlawful carnal knowledge, while the mistrial in Ourtic Gillard’s robbery case will be heard at the May Assizes.

     

    The unlawful carnal knowledge matter involving Jermaine Charles and Dwayne Stevens, which was traversed from previous assizes, was nolle prossed.

     

    The next assizes will begin on Tuesday, May 10 at the Basseterre High Court.
