Charlestown, Nevis: Sean Browne, 27, will serve a three years jail term with hard labour, for causing grievous bodily harm to Gerald Benjamin.

Browne, dressed in a green, white stripped sweat shirt, jeans and a pair of snickers was whisked out of the High Court, this morning after being committed to jail by Justice Francis Bell.

Earlier, the court heard that on June 15 2007, Benjamin left work and when he later came home, he found the door of his house open.  Browne’s clothes were inside the house.

Asked in court why his clothes were inside the house, Browne who was not represented said the house used to belong to him.

On June 16 2007, at 5.a.m, Benjamin heard a bang on his house.  When he checked, it was Browne banging the house.  Later when Benjamin was on his way to a shop, Browne attacked him.

When asked by His Lordship why he had banged the house, Browne told the Justice Bell that he mistook the house. He also told the court that Benjamin had first attacked him with a cutlass and consequently he (Browne) had defended himself by hitting him with a stick.

~~Adz:Right~~ When he was questioned as to why he had not told the Police about the cutlass when he was arrested, he said he had recorded the attack with a cutlass in his statement.  But when Justice Bell checked his statement, there was no record about the cutlass.

“Strange.  There is absolutely no record.  Something is being manufactured,” said His Lordship.  The medical report, said Justice Bell, showed that Browne had hit Benjamin and fractured the complainant’s 7th, 8th and 9th ribs.

“You have quite a record,” Justice Bell said.  Justice Bell told the court Browne had seven previous convictions and has served a two-year jail term in the past.

“There is an element of violence,” His Lordship said in reference to Browne’s history, “It seems to be the first time you are attacking somebody.  There is no truth about the cutlass …you would have told the Police that it was self-defence.”

“There is no mention of cutlass in this case.  I cannot believe you on the cutlass.  It seems to be a deliberate attack.  The last time you got two years, this time you will get three years with hard labour. You attacked violently.  Take him down please,” Justice Bell said in his ruling.
