“Mario Harvey - a very sick man who needs professional help,” says Probation Report
BASSETERRE, St. Kitts – MARIO HARVEY, 39, who changed his plea from not guilty to guilty for the crime of rape was given 13 years and four months in prison by His Lordship Justice Errol Thomas, on Monday Oct. 31.
“If the court could have imposed the maximum sentence on you, you would have got it,” said His Lordship. “But because you pleaded guilty, a third of your sentence will be reduced according to the law.”
Harvey is accused of raping a handicapped woman (suspected to be in her fifties) in her home, and according to the facts read in court, the victim had known the accused for several months.
Harvey telephoned the woman and told her he wanted to pass by and see if she could stand on her own.
When Harvey arrived at the home it was said that the victim’s mother was also at home.
He then forced her to remove her undergarments which included a pamper and started to have sexual intercourse with her.
She told him to stop because she was hurting and finally he did and left. Following his exit the woman reported the incident to her mother who called the police.
After the facts were read, Harvey made his mitigations where he told the court that he has a wife and a family and is a helpful man in society.
“I was falsely accused of the matter; I wasn’t in the area or no way around. I’m a young person coming up and I’m asking for mercy,” he said.
According to the social inquiry report prepared by Probation Officer Jerold Connor, Harvey is a very sick man who needs professional help.
In the report, Connor stated that Harvey should be dealt with the full extent of Law.
In 1993 he was sentenced to 15 years for unlawful carnal knowledge and was convicted (along with Joseph Herbert) earlier this year for buggery of young boy.
“You have three sexual serious offenses and you coming here asking for mercy?” His Lordship said. “Anyone would take stock of their life but you went on to commit more crime.
His Lordship then gave him a sentence of 13 years and four months which will begin after his ten year sentence - which was imposed on him earlier this year for buggery.
