Murder and manslaughter cases to be appealed next week

    BASSETERRE, St. Kitts - THE Eastern Caribbean Supreme Court of Appeal would be sitting next week (Nov. 26-30) at the Sir Lee Llewellyn Moore Llewellyn Moore Judicial and Legal Complex, where a number of criminal and civil matters are expected to be heard.

     

    Among the list of criminal matter are one murder and one manslaughter appeals - Gregory Che ‘Duck Foot’ Spencer and Louis Richards respectively.

     

    Spencer would be appealing against his conviction of the murder of Jason ‘Warlo’ Marsham.

     

    According to a previous report, the evidence presented in court against Spencer showed that he murdered Marsham on December 6, 2006 just outside his Godwin Ghaut home.

     

    Witnesses told the court that Spencer and three other individuals (Valmon ‘John’ Williams, Canta Bowry and Devon ‘Pacal’ Henry) had journeyed to Marsham’s residence on December 6, 2006 and summoned him outside. They further claimed that while Marsham and Pacal were speaking, Spencer told him [Marsham] there is something in his vehicle that belonged to him and he needed it.

     

    The prosecution witnesses said there was an exchange of words and Marsham had two bottles and was advancing towards Spencer when his sister, Rosalyn Marsham, decided to stand between the two men. The witnesses also claimed that Marsham did not use the bottles during the confrontation.

     

    Spencer, as the prosecution’s case outlined, hoisted his shirt, removed a firearm and fired a shot at the deceased which caught him on the forehead and a second one that struck him in the chest. 

     

    Prosecution witnesses further said that Spencer made his escape through some bushes while Williams went down the road on foot and the other two boarded the vehicle and left the scene.

     

    Former Defence Force Private Richards had his appeal against conviction of manslaughter adjourned from the appeal court sitting in March 2011 and is now scheduled to be heard next week.

     

    According to evidence in the case, on the night of August 3, 2007, Richards was shot while at the Lovers’ Bar in Old Road. Sometime later, he returned fired a shot which struck Addren ‘Ado’ Searles in his arm.

     

    He also shot Clyde Williams who succumbed to his injuries.

     

    Sometime after, Richards, in the company of fellow Strike Force operatives, walked to the eastern end of Old Road where he saw Jevon ‘Herbie’ Woodley, whom he said was motioning so as to remove a weapon from his waist.

     

    At that point, Richards shot Woodley once and, as he tried to flee, the soldier shot him two more times.

     

    Under oath, Richards told the court that Searles and Woodley were two of the three persons he saw shooting at him during the first phase of the incident.

     

    He was sentenced to 12 years imprisonment for manslaughter.

     

    Both cases are expected to be heard next week.
