Four criminal appeal cases traversed

    BASSETERRE, St. Kitts - AS the November 2012 sitting of the Eastern Caribbean Supreme Court of Appeal came to a close, four criminal cases that were on the docket to be heard had to be adjourned to the March 2013 sitting.

     

    The cases are those of Kenrick Hendrickson, Louis Richards, Alexter Amory and Leon Phillip, and Neil Duporte.

     

    The Office of the Director of Public Prosecutions (DPP) was appealing against the sentence of Hendrickson who was convicted of indecent assault.

     

    The prosecution requested an adjournment to the next sitting as the appellant was not prepared to argue the case.

     

    Former Defence Force Private Richards, who was convicted for the August 3, 2007 murder of Clyde Williams and sentenced to 12 years imprisonment, made an attempt to argue his case, unrepresented.

     

    After it was clear that Richards was incapable of representing himself, a request was made by the DPP's Office to have the case traversed so as to give him time to consult an Attorney.

     

    Amory and Phillip were appealing their conviction and sentence of armed robbery but could not proceed, as their legal representative was not present in Court due to health concerns.

     

    Duporte of Hardtimes Village in Nevis was appealing his conviction of possession of a controlled drug and his sentence, which was a fine of EC$10 000 payable in six months or, if in default, 12 months imprisonment.

     

    The cases were however adjourned to March 2013.

     

    Meanwhile, Vinceroy Chumney, who pleaded guilty to breaking and entering on March 31, 2009 and sentenced to five years imprisonment, withdrew his appeal.

     

    The unheard cases are expected to be argued at the March 2013 sitting of the Court of Appeal.
