19 unheard cases traversed to next Criminal Assizes

    BASSETERRE, St. Kitts - AT the close of the September 2012 Criminal Assizes on Thursday (Dec. 13), 19 cases were unheard and are therefore traversed to the sitting of the next assizes.

     

    The majority of traversed cases were those involving murder and/or manslaughter and sexual matters.

     

    The cases were those of Akeem Chumney; Erastus Laville; Jahmal Heath; Jahmana Walters, Ali Percival, Clayton Laws and Jermaine Riley; Kevin Pierre; Nelson Challenger, Shenroy Francis, Jomi Rawlins, Glenroy Smithen an Moses Gardener; Amal Whyte and Devon Fyfield; Denver Fyfield; Kern Cabey; Kelroy Hazel and Jahari Bart; Esroy Mills; Ishaun Wilkes and Sheldon Cannonier; Jahmari Lake an Leon Jederon; Angel Palmer, Arismandi Rivera, Juan Frederico Samiento, and Ramon Benitezsaba; a juvenile; and five unnamed men.

     

    Chumney is charged with assault with intent to rob Cindy James-Carey, which is said to have been committed at Hermitage Village, Lower Cayon on November 4, 2011, while Laville is facing a murder charge. He is accused of killing Wendell Wilkinson in Basseterre on July 8, 2011.

     

    Heath is charged with the attempted murder and wounding with intent of Curtis James, which is said to have been committed on December 10, 2011, while Pierre is charged with the unlawful wounding and wounding with intent of Ian Morris in Basseterre on October 21, 2009.

     

    Walters, Percival, Laws and Riley are jointly charged with two counts of kidnapping on October 28, 2011. They allegedly kidnapped Larry Vaughn and Gilda Vaughn.

     

    Challenger, Francis, Rawlins, Smithen and Gardner are still awaiting their trial for the murder/manslaughter of Gregory Zakers on April 10, 2008.

     

    Denver Fyfield is charged with the murder of Hendricks Roberts who was killed sometime between June 20 and June 21, 2010, while Whyte and Devon Fyfield are yet to be tried for the June 23, 2005 murder of Hubert Phipps.

     

    Cabey was already tried during the May 2012 Criminal Assizes for endangering life and enabling other people to endanger life for the January 14, 2010 shooting that took place at the RLB International Airport Fire Hall.

     

    The 12-member jury that sat on his case brought back a unanimous not guilty verdict on the first charge, but a seven-five hung jury on the latter. He is expected to stand trial again during the next Criminal Assizes.

     

    Hazel and Bart were already tired for the April 4, 2011 murder of Laustin Jamie 'Big Ship' Williams at Buckley's Estate. After more than one week into their trial the case was declared a mistrial following the discovery that one of the jurors was a relative of the accused.

     

    They too are expected to stand trial again at the next Criminal Assizes.

     

    Mills' case was heard during the May 2012 Criminal Assizes and had ended in a hung jury. This, too, is expected to be heard again at the next Criminal Assizes.

     

    The juvenile is faced with a murder charge for the April 3, 2009 killing of 14-year-old Bejay Dore, while Wilkes and Cannonier are jointly charged with assault with intent to commit a felony at Bird Rock on May 18, 2011.

     

    Lake and Jederon are facing two counts of robbery on 26 April, 2011 at Conaree Village, where they are alleged to have stolen a quantity of jewellery valued at EC$41 063 and EC$ 48 200 from two females. They are also charged with receiving the items.

     

    Palmer, Rivera, Samiento and Benitezsaba are jointly charged with attempted larceny at the Conaree Landfill on January 1, 2010. They are said to have attempted to steal transformers, used batteries and copper, property of Sylvester Tweed.

     

    Two men are facing sexual charges of rape committed on February 19, 2011 and also unlawful carnal knowledge allegedly committed on June 1, 2011; while another is charged with one count of rape and one count of unlawful carnal knowledge allegedly committed on June 27, 2011.

     

    Two unnamed men are each charged with one count of unlawful carnal knowledge allegedly committed on October 31, 2011 and June 1, 2011.

     

    These cases are expected to be heard at the January 2013 Criminal Assizes.

     

    Likewise, the sentencing of Alpha Duporte, who was convicted for the murder of Dexter ‘Asbal’ Marsham and the attempted murder of Royden Gumbs and Jessica Gumbs, would be heard sometime during that Assizes.
