BASSETERRE, St. Kitts - HIS case ended with a hung jury in May 2012 and it is now before the Basseterre High Court for a second hearing.
The case is that of Esroy Mills who is charged with one count of shooting at with intent and another count of assault with intent to commit a felony.
At its first hearing, the trial ended with an 8-4 deadlock for the assault with intent to commit a felony charge and 9-3 for shooting at with intent.
With Dennis Merchant leading the prosecution, the retrial began yesterday (Mar. 19), while Mills is once again being represented by Attorneys-at-Law John Cato and Fitzroy Eddy.
Four persons are expected to give evidence on behalf of the prosecution; three of whom have already testified, including Bichara Isaac and the investigating officers.
They would testify that sometime after 4:00 p.m. on July 4, 2011, Mills shot at Isaac while he was in the vicinity of the Cayon Primary School and that on the same day he pointed a gun at Glenroy Stanley with intent to commit a felony.
Isaac, in his testimony, stated that on the said date he was at his cousin's home in Market Alley, Lower Cayon and while walking from that house with a friend sometime after 4:00 p.m. he was shot at by an unknown assailant.
He said he heard shots being fired and, although he did not know where they were coming from, he immediately ran for his life.
Isaac also said he had looked behind him and saw smoke, and further testified that he also saw someone dressed in all black.
The witness also testified that he did not see the person's face or could he describe the individual because he was "frightened" and was "focusing on running".
Isaac said he had heard what sounded like four gunshots while in Market Alley and he ran through the Cayon Primary School, where he saw children waiting on the school bus.
He stated that he ran through the school's yard and when he paused to check himself for wound, he heard what sounded like two more gunshots being fired at him.
He testified that he looked and saw smoke and someone wearing black pants.
He told the Court that he ran across the school's football field and then to his home.
Isaac also told the Court that while he knows Mills, they do not get along.
The case continues today (Mar. 20) with the cross examination of those witnesses who have already testified.
