BASSETERRE St. Kitts, July 23rd, 2013 -- The Lodge Patriots F.C wishes to advise the other member clubs of the SKNFA and the general public that because the SKNFA has denied the Lodge Patriots FC of their fundamental and constitutional rights of a hearing or Arbitration on several matters that are before the SKNFA, the Lodge Patriots FC will seek legal counsel to enforce the discipline of the SKNFA statutes.
The Lodge Patriots FC is disputing the SKNFA executive decisions on matters - Lodge Patriots FC vs Rivers of Living Water FC where a player was ineligible to participate in the said match and Lodge Patriots vs Youth and Experience FC where the SKNFA decided to overturn point that they had already awarded which does not merit the SKNFA Rules and Regulations nor the SKNFA Statues. The SKNFA executive committee is adamant in refusing to discuss the matters with the Lodge Patriots FC and nor are they willing to allow Arbitration on the matter.
The SKNFA claims ‘The matter does not amount to a matter for arbitration” in their letter of response to the Lodge Patriots FC, hence the SKNFA statutes that article 62 ‘SKNFA shall create an Arbitration Tribunal, which shall deal with all internal national disputes between SKNFA, its Members, Players, Officials and match and players’ agents that do not fall under the jurisdiction of its judicial bodies.
The Executive Committee shall draw up special regulations regarding the composition, jurisdiction and procedural rules of this Arbitration Tribunal” at no pint does the statue dictate what ‘amount” for a matter to meet arbitration, the statues provides for an Arbitration Tribunal to bring relief from disputes between the SKNFA and its stakeholders. Yet the SKNFA is stating “the SKNFA executive body has the ultimate responsibility to resolve matters…” and “this decision stands as the final decision on this matter”
It is clear that the SKNFA’s decisions are contrary to that of the SKNFA statues and is destroying the right and privilege of its member clubs. The Lodge Patriots FC have been very calm and patient on the matter and the Lodge Patriots FC has no intentions to bring the football into any disrepute.
However the Lodge Patriots FC and the community of Lodge and Ottleys will not allow the SKNFA to manipulate and destroy the hard work of the young men who participated and represented the communities in the Division I football league and is prepared to take the necessary steps to ensure justice is served.
