Injunction judgment overturned

    UPDATE: SKNVibes understands that the Court of Appeal has just overturned the judgment of Justice Marlene Carter and reinstated the injunction.

    BASSETERRE, St. Kitts – AT 6:00 p.m. today (Jan. 29), the Eastern Caribbean Supreme Court would hand down its ruling on whether or not it would reinstate the injunction which was dismissed by the lower Court.
     
    The appeal case was heard throughout the course of the day via teleconference among counsel for the government, Opposition and the Court of Appeal.

    The opposition filed the appeal yesterday, one day after High Court Justice Marlene Carter discharged the injunction she had imposed restraining use of the final Report of the Constituency Boundaries Commission for the purpose of making a proclamation for boundary changes.

    The Opposition had applied to the High Court for the injunction to be extended pending the appeal, but that was not granted. They indicated however that they would proceed with the appeal.

    SKNVibes understands that the teleconference was among Anthony Astaphan QC in Dominica; Chris Hamel-Smith in Barbados, Lord Peter Goldsmith in the UK, Sylvester Anthony, Dr. Henry Browne QC and Douglas Mendes in St. Kitts, as well as the Chief Registrar in St. Lucia and the Registry in St. Kitts.

    The hearing was scheduled for 9:15 this morning but began two hours later because certain documents were not delivered on time to the various parties.

    After a break for lunch, the session resumed at 2:45 p.m. and Astaphan – representing the government - and counsel for the Opposition had already made their submissions and Goldsmith was making his.

    The Court of Appeal indicated to the parties that it would make its decision this evening.
