Comment: Tell the truth Erasmus! In the same 7 page judgment the judge goes on to say:
“One is here concerned with, among other things, the right to free and fair elections, a fundamental right accorded by the Constitution among other things and when viewed in that light the injunction does not offend but can be seen as necessary as an interim measure” (p.5-6)
Joseph-Olivetti continued, “I have considered all the circumstances and find that the non disclosure was not deliberate and was in part occasioned by the urgency of the matter having regard to the rapidity with which the Government in the face of court proceedings in Suit 159 moved to lay the Report before the National Assembly and to have it approved before the court could make a determination on the substantive issues” (p. 6)
